PPC Bidding and Violations

If you have ever wondered why advertisers ask that you do not bid on their brand name there are multiple reasons. If you bid using Pay Per Click (PPC) advertising on search engines you may have seen a message like this:

We have seen a lot of publishers bidding on our brand name. If you are bidding on our brand name or any variation of it please pause your campaign immediately! From now on we will strictly enforce our terms. To prevent any discomfort please make sure you are not violating our program terms.

There may be many reasons why they prefer you do not bid on their brand name and one is due to it being a Trademark. As an owner of a trademark you do not want others using that trademark. You need to control the usage of the mark and assure that no one is trying to profit from your good will and the value you have created around that mark. The owner of the mark prefers that they, and they alone, control the advertisements that appear when their mark is searched for. This allows them to control the advertisements and the pages that are shown after an advertisement is clicked. The owner of the mark does not want their mark to be diluted or seen in a negative light for any reason. Allowing many affiliates to bid on their name and present websites as if it is the owner of the marks site, takes away the control of the content from the mark owner.

I have received questions about the bidding of brand names and why advertisers care, hopefully this explains it.

Domain Reminder

As it is almost June, mid-year, I suggest you check with your domain registrar to assure you have not forgotten to renew any of your domains. This is actually a practice you should employ monthly. You do not want to forget to renew your domains. There are a couple options to relieve you of this monthly chore.

Renew for a Number of Years
First you can renew domains for more than 1 year. This would relieve you of having to renew yearly. Of course if you have many domains this could be very costly, here are two more options.

Auto Renew Feature
Here are step by step instructions to setup the auto-renew feature using GoDaddy. By using auto-renew you can set up an automatic payment so your domains will be renewed automatically. Most registrars have multiple payment options such as either credit card, paypal or others. You can use one of these godaddy coupons when renewing.

Consolidate Domains
Yet another option is to consolidate your domains. You can consolidate the month and day that each domain is to renew. By doing this you would only need to renew your domains all at one time each year. Here are instructions to consolidate your domains so they expire at the same time if you use Go Daddy.

Skype Sold for $8.5 Billion

Skype was founded in 2003, eBay bought it in 2005 for $2.6 billion. eBay later sells 70% of the company to investors in 2009. In 2011 Microsoft buys skype for $8.5 billion. In just 8 years the company went from inception to a sales price of $8.5 billion, that is nothing short of impressive. When looking to learn from a case study Skype is a great one.

Take a look at this time line of Skype from inception to the most recent acquisition. The image is incredible. See the image here.

Federal Government Slows Innovation Intentionally

You may agree or disagree with the title of this article but here are the facts. Many people do not realize these facts about The United States Patent and Trademark Office (USPTO). Here they are and then we will discuss what is happening.

  • the USPTO generates revenue from filing and other fees (most federal agencies do not generate revenue)
  • the USPTO is profitable, it generates more revenue than it spends each year (no other agency is profitable, to my knowledge)
  • the Federal government will not let the USPTO use all the fees it receives, the Federal government takes money away from the USPTO and gives it to other agencies
  • the USPTO has a backlog of patent applications, over 700,000 are waiting in line to be reviewed

Those are the facts. It may be a surprise to you that the USPTO, a government agency, is actually profitable. This is something the government likes to keep quiet because they like to take the money from that agency and spend it elsewhere. Since that is done every year we are essentially taxing inventors as their patent fees are used in other areas of the government. As if you are not taxed enough, just know that as an inventor you are proportionally taxed more. I am not sure how that assists in innovation as it does not seem as though a tax on inventors would be an incentive. Good news is that inventors do not see it that way and consider it a cost of doing business.

Slowing Innovation
The real issue is that it currently takes about 3 years for your patent application to be decided on. There is an entire process for patent examination but I will not go into that now. The point is that if we want these patents to be examined faster do not take away the money of the agency. What is interesting is that in most cases when arguing for an agency to retain their current budget level or receive more funds you are typically asking for them to get more money and either the U.S. goes into deeper debt, another agency has to take a cut, or taxes go up. None of those is the case here. This agency generates revenue and is not allowed to retain the revenue it generates. Let them keep the money, examine patents faster, and therefore we speed our innovation to market, generate more jobs and increase the overall wealth of the country. If the U.S. really cares about innovation then get your hands out of the Patent Office’s pocket.
